The terms “we,” “us,” and “our” refer to The Sumo Library. The term the “Site” refers to thesumolibrary.com. The terms “user,” “you,” and “your” refer to site visitors, customers, and any other users of the site.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. 6. Your Contributions are not obscene, defamatory, harassing, or otherwise objectionable.
7. Your Contributions do not ridicule, threaten, or intimidate anyone.
8. Your Contributions do not promote violence, illegal activity, or harm against others.
9. Your Contributions comply with all applicable Kenyan laws and regulations.
10. Your Contributions do not invade anyone’s privacy or violate their rights.
11. Your Contributions do not solicit or exploit minors in any form.
12. Your Contributions do not violate laws related to child protection.
13. Your Contributions do not contain offensive or discriminatory remarks based on race, gender, nationality, or disability.
14. Your Contributions do not violate these Terms or link to illegal or prohibited content.

Violating these terms may result in suspension or termination of your access to Sumo Library and its services.

By submitting suggestions, feedback, or other input regarding the Sumo Library website, you agree that we may use and share such feedback for any purpose without compensation to you.

We do not claim ownership over your Contributions. You retain full ownership of all your Contributions and any related intellectual property or proprietary rights. Sumo Library is not responsible for any statements, representations, or content you submit on the platform. You are solely responsible for your Contributions and agree to release us from any liability or legal claims related to them.

We may accept, reject, or remove reviews in our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us, and do not necessarily represent our opinions or the views of any of our affiliates or partners. We do not assume liability for any review or for any claims, liabilities, or losses resulting from any review. By posting a review, you hereby grant to us a perpetual, non-exclusive, worldwide, royalty-free, fully-paid, assignable, and sublicensable right and license to reproduce, modify, translate, transmit by any means, display, perform, and/or distribute all content relating to reviews.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

We cannot guarantee the Site and the Marketplace Offerings will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Site or the Marketplace Offerings at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Site or the Marketplace Offerings during any downtime or discontinuance of the Site or the Marketplace Offerings. Nothing in these Terms of Use will be construed to obligate us to maintain and support the Site or the Marketplace Offerings or to supply any corrections, updates, or releases in connection therewith.

The arbitration shall be conducted in accordance with the Chartered Institute of Arbitrators – Kenya Branch (CIArb-Kenya) Arbitration Rules. Arbitration fees and arbitrator compensation shall be governed by these rules. The arbitration may take place in person, through document submissions, by phone, or online, as agreed upon by the Parties. The arbitrator will issue a written decision but is not required to provide a statement of reasons unless requested by either Party. The arbitrator must adhere to applicable laws, and any award may be challenged if the arbitrator fails to do so.

Except where otherwise required by applicable arbitration rules or Kenyan law, arbitration will take place in Nairobi, Kenya. The Parties may pursue court proceedings only to compel arbitration, stay proceedings pending arbitration, or confirm, modify, vacate, or enforce an arbitration award.

If, for any reason, a Dispute proceeds in court rather than arbitration, the Dispute shall be filed in the High Court of Kenya in Nairobi. The Parties consent to the jurisdiction of this court and waive any objections based on lack of jurisdiction or inconvenient forum.

The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) and the Uniform Computer Information Transactions Act (UCITA) is excluded from these Terms of Use.

In no event shall any Dispute related in any way to the Site be commenced more than one (1) year after the cause of action arose. If any part of this provision is found to be illegal or unenforceable, then the affected portion will be handled by a court of competent jurisdiction, and the Parties agree to submit to the personal jurisdiction of that court.
